Rental Agreement - Terms and Conditions

The purpose of this website (�Site�) is to establish a rental agreement between you (the �Client�) and White Storm (�WS�) to rent snow equipment (�Equipment�) chosen on this Site, in a resort chosen by you for a period determined by you at a price determined on this Site. Access to and use of this Site for the above-stated purpose is provided by White Storm, registered under 753 976 380 at the RCS CHAMBERY. By using this Site you agree to be legally bound by these Terms and Conditions, which take effect immediately on your first use of this Site.

Payment

Your transactions with WS are made in �uros. The amount to pay will be determined on the Site. WS has no control over the exchange rate used by your local bank to convert this amount to your local currency. No liability will be accepted for any variation in the exchange rate applied by your bank at the time of any subsequent transactions with WS.

Insurance

The cost of rental does not include any insurance. Purchase of White Storm�s Theft and Damage Cover is available upon completing the online booking or upon arrival in resort. The cost of this is 1,5�/day for Kids, Junior Blue, Junior Red and Junior Snowboard equipment. 3�/day for adult Blue, Red Economy, Red and Black categories. 4�/day for Diamond and Infinity categories. This guarantee covers replacement costs in case of Theft or Damage to the equipment, providing common sense was used. -Theft: the Client will need to provide a police report from the local station, detailing the incident. Equipment left in public areas without surveillance will not be covered by the guarantee. -Damage: normal wear and tear on all rental equipment is to be expected. Extensive damage beyond repair will be covered by the guarantee unless it is deemed due to misuse of the equipment, such as � but not exclusively � skiing on roads/sidewalks, use of the equipment as weapons, kindling, furniture, shields, and generally any other use than the one intended. The appreciation of the damage is understood to be that of the shop�s manager on duty. The following costs of replacement apply, should the damage or theft not be covered by White Storm�s Cover: � Kids & Junior skis/boards: 150� � Adult Blue: 200� � Adult Red: 300� � Adult Black: 400� � Adult Diamond: 500� � Adult Infinity: 700� � Helmet: 30� � Poles: 15� (1 or 2 poles) Note that there is an excess due of 100� on Diamond and 150� on Infinity, when the White Storm Cover is used.

Deposit

Upon pickup of the Equipment, credit card details are required by the shop and kept until the Equipment is deemed returned in satisfactory condition. The Client agrees that any outstanding money owing that has not been settled can be charged to the Client�s credit card at White Storm�s discretion.

The Shop�s Commitments

On creation of the booking, White Storm agrees to supply the Client with Equipment of a specified standard at a specified price. The Client can specify a preference for a particular model and White Storm will endeavour to provide that model, but cannot guarantee its availability.

White Storm agrees to provide the Client with suitable and fitting equipment, that has been serviced prior and is set to the Client�s personal information, as provided. The Client is solely responsible of the use that Equipment.

Cancellations and Refunds

Cancellations may be made up to 10 days in advance. The amount to be refunded will be done so on the credit card used upon booking.

Equipment � Disclaimer and Limitation of Liability

The Client is solely responsible for the accuracy of the information provided and use of the Equipment provided. The Client understands that there are inherent risks of injury and damage to property from all snow sports for which White Storm or its employees cannot be held liable. The Client understands that while ski bindings have been set to safe standards, they will not release at all times or under all conditions, and that while risks are reduced from safe settings, they are not eliminated.

Jurisdiction and Venue

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of France and you submit to the exclusive jurisdiction of the courts of France.

Governing Language

The governing language of these Terms and Conditions shall be French. Any translation of these Terms and Conditions into any language other than French shall be provided for information purposes only. The legally binding version of these Terms and Conditions shall be the French language version. Any dispute with respect to these Terms and Conditions shall be resolved with reference to the French language version only.
